Terms and Conditions

1. Acceptance of Terms

By accessing or using brainandbounce.com, the web app at brainandbounce.com/app, or our mobile apps (together, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Platform. Brain and Bounce Kids is provided by CodeXOps Technologies Private Limited (“we”, “us”). These Terms cover Brain and Bounce Kids (for children in classes 1–5) only. Any other Brain and Bounce app (for example one for adult learners) has its own terms.

If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian.

2. Description of Service

Brain and Bounce Kids is an educational platform that helps children in school classes 1–5 learn through quizzes, practice missions and interactive content. It includes:

• Quiz and practice modules across subjects, with difficulty that adapts to the child
• Missions, coins, points, ranks, badges, avatar items and leaderboards
• Progress tracking, and weekly and monthly progress reports for parents

We may modify, update or discontinue any part of the Platform at any time.

3. Eligibility

• The Platform is for children learning with parental guidance and for parents and guardians.
• To create an account, subscribe or make any payment you must be at least 18 and able to enter a binding contract.
• Parents and guardians are responsible for supervising how children use the Platform.

4. Accounts and explorer profiles

• A parent or guardian creates one account (with an email address, or Google sign-in) and adds an “explorer” profile for each child. Children do not create accounts of their own.
• You agree to give accurate information, keep your login private, and take responsibility for everything done under your account and your explorers' profiles.
• Free trials, subscriptions and offers belong to a single explorer profile, not to the account as a whole (see sections 5 to 9).
• You can delete your account at any time in the Parent Zone. See the Privacy Policy for what happens to data.

5. Free trial

• Every explorer profile gets a 14-day free trial, counted from the day the profile is created.
• No payment details are needed, and nothing is charged during or at the end of the trial.
• When the trial ends, missions and practice for that explorer pause until you subscribe. The explorer's progress, badges and streaks are kept.
• The trial is meant for genuine evaluation. Repeatedly creating profiles to get further free trials is not allowed, and we may decline to extend access if we see it.

6. Subscriptions and payment

• A subscription unlocks the Platform for one explorer profile, on a monthly or yearly plan.
• Web: prices are in Indian rupees and include GST. Android app: the price and currency are set by Google Play for your country and shown to you before you buy, and include any taxes that apply there. In both cases the price shown at checkout is the amount you pay.
• Web: payments made on brainandbounce.com are processed by Razorpay using UPI AutoPay, cards or netbanking, and you may need to approve the recurring payment with your bank. Android app: purchases are processed by Google Play under Google's terms. We never receive or store your card, UPI or bank details.
• A subscription renews automatically each month or year at the price you agreed to, until you cancel. You will be told of the renewal terms before you pay.
• If a renewal payment fails, access for that explorer pauses until the payment goes through or you subscribe again.
• If we change the price of a plan, subscribers will be told in advance and can cancel before the new price applies.

7. Offers and promo codes

• A promo code applies to one explorer profile and can be used once for that profile.
• Some codes are limited to the first customers to use them, or to a period of time, and may end at any time.
• A subscription bought with an offer keeps that offer price for as long as it stays subscribed. If you cancel and later subscribe again, the prices on sale at that time apply and the code cannot be used again.
• Codes have no cash value, cannot be transferred or sold, and cannot be combined unless we say so.
• We may cancel an offer or refuse a code if it was obtained or used by abusing the system.

8. Cancellation and refunds

You can cancel a web subscription at any time in the Parent Zone under Subscription & billing; access continues until the end of the period you have paid for. Subscriptions bought in the Android app are cancelled in Google Play. Refunds are described in our Refund and Cancellation Policy, which forms part of these Terms.

9. Access after a subscription ends

When a subscription ends, is cancelled at the end of its period, or a payment fails, that explorer's missions and practice pause. Profile data and progress are kept and become available again if you resubscribe. Access can also be provided without payment in limited cases, such as an account we grant complimentary access to; that access can be withdrawn.

10. User conduct

You agree not to:

• Use the Platform for unlawful purposes
• Share harmful, offensive or inappropriate content, including in call signs
• Put a child's real name, contact details or other personal information in a call sign or anywhere in the app
• Attempt to disrupt, damage, reverse-engineer or gain unauthorised access to the Platform
• Cheat, exploit flaws, or use automated tools to answer questions, earn rewards or claim offers
• Share your login, or resell or transfer a subscription or code
• Infringe anyone's intellectual property rights, or post defamatory, obscene or unlawful content

Security. You also agree not to: access data or accounts that are not yours; probe, scan or test the Platform for vulnerabilities without our written permission; interfere with or overload our servers, networks or the services we rely on; hack, deface or introduce malware; or send spam or bulk requests through the Platform. Breaking these rules may lead to civil or criminal liability, and we may report it to law enforcement. If you find a security problem, please tell us at hello@brainandbounce.com instead of exploiting it.

11. Educational disclaimer

Content on the Platform is for educational purposes. We work to keep it accurate, but we do not guarantee that it is complete or error-free, and the Platform does not replace formal schooling or professional advice.

12. Parental responsibility

Parents and guardians are responsible for monitoring their child's activity, for ensuring appropriate use, and for what their child does on the Platform.

13. Scores, rewards and leaderboards

• Coins, points, ranks, badges, avatar items and leaderboard positions are for motivation and have no monetary value.
• We may adjust, reset or remove them, for example to correct errors or misuse.
• Leaderboards show a call sign, character and score to other explorers in the same class level who take part; participation can be switched off per explorer.

14. Intellectual property

All content on the Platform, including questions, explanations, text, graphics, characters and design, is owned by or licensed to CodeXOps Technologies Private Limited. You may not copy, distribute or reproduce it, or use it for commercial purposes, without our written permission.

15. Privacy and data protection

Our Privacy Policy explains what we collect, who we share it with and your rights, and is part of these Terms. In summary: we process personal data under India's Digital Personal Data Protection Act, 2023, and children's data only with a parent's consent and without tracking or behavioural monitoring that could harm children. Where the US Children's Online Privacy Protection Act (COPPA) applies, we do not knowingly collect personal information from a child under 13 without verifiable parental consent. Parents can review, correct or delete their child's data, or withdraw consent, at any time by following the Privacy Policy.

16. Safety and child protection

We are committed to a safe learning environment for children. Please report inappropriate content or behaviour to hello@brainandbounce.com, and supervise your children's use of the Platform.

17. Suspension and termination

We may suspend or end access to the Platform, or to an account or explorer profile, if:

• These Terms are broken
• Misuse, fraud, abuse of offers or harmful behaviour is detected
• We are required to by law

You may stop using the Platform and delete your account at any time. Sections that by their nature should survive termination will continue to apply.

18. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any direct, indirect, incidental or consequential damages arising from your use of the Platform, a transaction made through it, or unauthorised access to or loss of data
• Our total liability to you for any claim is limited to the amount you paid us for the Platform in the 12 months before the claim arose
• We do not guarantee that the Platform will be uninterrupted or error-free

Nothing in these Terms limits any right you have as a consumer that cannot be excluded by law.

19. Disclaimer of consequential damages

We are not liable for loss of data, loss of profit or income, damage to your device, business interruption, or any similar loss, however it arises and under any legal theory, even if we were told it could happen. The Platform is provided “as is” and “as available”, and we do not promise any particular learning result, score, rank or exam outcome.

20. Indemnity

You agree to protect us, our directors, employees and partners from any claim, loss or liability (including reasonable legal costs) that arises from your use of the Platform, your breach of these Terms, or your infringement of someone else's rights, including anything done through your account or your explorers' profiles.

21. Pricing, taxes and availability of offers

On the web, prices are shown in Indian rupees and are inclusive of GST. In the Android app, Google Play shows the price in your local currency, including applicable taxes, before you buy. The price shown at checkout is the amount you pay, with no further tax added by us. Prices, plans, features and offers can change at any time, but a change never alters a subscription you have already paid for until its renewal, and subscribers are told in advance (section 6).

22. Availability of the Platform

We work to keep the Platform running, but we do not promise uninterrupted access. It depends on third-party hosting, internet, payment and email services, and on maintenance and updates, any of which can cause interruptions. We are not responsible for losses caused by these.

23. Third-party services and external links

The Platform uses services from others (for example Razorpay, Google, Apple and Cloudinary) and may link to other websites such as YouTube, Instagram and LinkedIn. We do not control them and are not responsible for their content, availability or privacy practices; their own terms apply. You may link to our homepage, brainandbounce.com, from your own site if the link text is accurate and does not suggest we endorse you, and we may ask you to remove a link at any time.

24. Logos, trademarks and brand

“Brain and Bounce”, “Brain and Bounce Kids”, our logos, characters and mascots are our trademarks or are used under licence. You may not use them without our written permission. Other names on the Platform may be trademarks of their owners.

25. Events beyond our control

We are not liable for failure or delay caused by events outside our reasonable control, such as outages of internet, cloud, payment or telecom providers, natural disasters, strikes, government action or cyber-attacks.

26. General

• If any part of these Terms is found invalid, the rest remains in force.
• These Terms, with the Privacy Policy and the Refund and Cancellation Policy, are our whole agreement with you about the Platform.
• You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganisation of our business.
• We may give you notice by email to your account address or by a notice in the app.
• Not enforcing a right straight away does not mean we have given it up.

27. Changes to these Terms

We may update these Terms. For material changes we will email the parent account or show a notice in the app before they take effect, and we will change the effective date above. Continuing to use the Platform after the changes take effect means you accept them; if you do not, you can stop using the Platform and cancel any subscription. The previous version was dated September 30, 2026.

28. Governing law

The Platform is operated from India. These Terms are governed by the laws of India, and disputes are subject to the jurisdiction of the courts in Greater Noida, Uttar Pradesh. If you use the Platform from another country, you remain entitled to any mandatory consumer-protection rights you have under the law where you live, and nothing in these Terms removes them.
